Malta — Dept. of Industrial & Employment Relations (DIER) ↗

Malta's standard week is 40 hours. Where overtime is not covered by a Wage Regulation Order, it is paid at 1.5× (time-and-a-half) for each hour worked over 40 a week.

  • Overtime not set by a Wage Regulation Order is paid at +50% (1.5×) over 40 hours a week.
  • Sector Wage Regulation Orders (WROs) may set different overtime rates.
  • Many collective agreements or contracts provide higher rates, especially for Sundays and public holidays.

This applies the 1.5× default rate; your Wage Regulation Order, collective agreement or contract may set a different figure.

Frequently asked questions

Is overtime pay the same across the EU?

No. The EU Working Time Directive sets shared limits — an average 48-hour maximum week (including overtime), minimum daily and weekly rest, and paid leave — but it does not set overtime pay rates. Premiums are decided nationally, and in several countries by collective agreement rather than statute.

How is overtime paid in Malta?

In Malta, overtime above 40 hours a week is paid at a statutory premium of 50%. Higher rates can apply for night, Sunday and public-holiday work. See the rules below for the exact figures.

Can a collective agreement change the overtime rate?

Yes. In most EU countries a sector or company collective agreement can set overtime rates above the statutory minimum, or replace premium pay with compensatory time off. Always check the agreement that applies to your role.
