Spain Overtime Rules
Spain sets no minimum overtime premium beyond the ordinary hourly rate. Overtime (horas extraordinarias) must be paid at least at the normal rate or compensated with rest; the actual premium is set by the collective agreement (convenio colectivo).
- Under Article 35 of the Workers' Statute, overtime is paid at a rate no lower than the ordinary hour, or compensated with equivalent rest.
- Collective agreements commonly set higher rates — often +50% to +100% for weekend, holiday or night work.
- Voluntary overtime is capped at 80 hours a year for full-time workers.
