France Overtime Rules
France's legal working week is 35 hours. Overtime (heures supplémentaires) is paid at +25% for the first 8 hours (the 36th to 43rd hours) and +50% from the 44th hour.
- Overtime is paid at +25% for the first 8 overtime hours each week, then +50% beyond that.
- The default annual overtime quota is 220 hours; a collective agreement (convention collective) can change both the quota and the rate (minimum +10%).
- Maximum working time is generally 48 hours in a week (or 44h averaged over 12 weeks), with at least 11 hours of daily rest.
This estimates the statutory default. Your sector's collective agreement may set a different overtime rate (no lower than +10%) or replace pay with compensatory rest. The calculator applies 25% to the first 8 overtime hours and 50% beyond.
Frequently asked questions
No. The EU Working Time Directive sets shared limits — an average 48-hour maximum week (including overtime), minimum daily and weekly rest, and paid leave — but it does not set overtime pay rates. Premiums are decided nationally, and in several countries by collective agreement rather than statute.
In France, overtime above 35 hours a week is paid at a statutory premium that rises with the number of overtime hours. Higher rates can apply for night, Sunday and public-holiday work. See the rules below for the exact figures.
Yes. In most EU countries a sector or company collective agreement can set overtime rates above the statutory minimum, or replace premium pay with compensatory time off. Always check the agreement that applies to your role.
